Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Heyperai (“Heyperai”, “we”, “us”). They apply to heyperai.com, the Heyperai apps and studios, and everything else we provide (together, the “Service”).

By creating an account or using the Service you accept these Terms, together with the policies they refer to: the Privacy Policy, the Acceptable Use Policy, the Refund & Cancellation Policy and the Copyright & Takedown Policy. If you use the Service on behalf of an organisation, you confirm you are authorised to accept these Terms for it, and “you” includes that organisation.

You must be at least 18 years old, and able to form a binding contract, to use the Service. You can sign up with an email address and password, or with a Google or X account.

• Give us accurate information and keep it up to date.
• Keep your sign-in details secure. You are responsible for activity on your account, and should tell us straight away at hello@heyperai.com if you think someone else has access to it.
• An account is for one person. Don't share it, sell it, or create accounts in bulk or by automated means.

Heyperai lets you generate and edit images and video with AI models, edit video through its transcript, build workflows, find clips, and use related tools. Many models are provided by third parties and run through their infrastructure.

The Service is changing quickly. We may add, change or retire features and models, and we will try to give reasonable notice before removing something you actively use. Some features may be labelled beta or preview; they are offered as they are and may change or stop without notice.

Most work in Heyperai costs credits. Each job's cost is shown before you run it and is listed on the pricing page.

• Monthly allowance. Every plan, including the free plan, includes a credit allowance that refreshes each billing period. Unused allowance does not roll over.
• Credit packs. Credits you buy in a pack do not expire while your account is open, and are only used after your monthly allowance runs out.
• Failed jobs. Credits are reserved when a job starts and returned automatically if it fails or produces nothing.
• Credits have no cash value, cannot be transferred or sold, and are not a currency or stored-value product.

Paid plans are subscriptions that renew automatically at the end of each billing period until you cancel. Payments are processed by Razorpay; we never see or store your full card number. Prices are in US dollars and may exclude taxes, which are added where the law requires.

If we change the price of your plan, we will tell you at least 30 days before the new price applies to your next renewal, and you can cancel before then. If a renewal payment fails, we may retry it for a short grace period before moving you to the free plan. Cancellations and refunds are covered by the Refund & Cancellation Policy.

“Inputs” are what you give the Service — prompts, images, video, audio and other files. “Outputs” are what the Service generates for you. Together they are “Your Content”.

• You keep your rights in your inputs. You confirm you have the rights and permissions needed to upload them and to have them processed.
• Outputs are yours. As between you and us, you own your outputs and may use them for any lawful purpose, including commercially, on every plan. We do not watermark them.
• Outputs may not be unique. AI models can produce similar output for different people, and the law in some countries gives limited or no copyright protection to purely machine-generated work. You are responsible for checking an output is fit for how you use it.

You give us a limited licence to host, store, copy, process and transmit Your Content only as needed to run the Service for you — for example, to send a prompt and a reference image to the model you chose, and to keep your results in your library. We do not sell Your Content, and we do not use it to train our own AI models.

You must follow the Acceptable Use Policy. In short: nothing illegal, no sexual content involving minors, no non-consensual intimate or deceptive imagery of real people, no infringement of others' rights, and no attempts to abuse, overload or get around the limits of the Service. We may remove content or restrict accounts that break it.

Some features rely on services we don't control: AI models from third-party providers, sign-in through Google or X, payments through Razorpay, and stock media from Unsplash, Pexels and Pixabay. Stock media remains subject to its provider's licence. Where a model provider imposes conditions on how its model's output may be used, we will point them out where the model is offered.

Our blog contains links to other websites, some of which are affiliate links that may earn us a commission. We are not responsible for the content or practices of other websites.

The Service itself — its software, design, text, the Heyperai name and logo — belongs to us or our licensors and is protected by law. These Terms give you a personal, non-exclusive, non-transferable right to use the Service as intended while your account is in good standing. You may not copy, resell, reverse engineer or build a competing product from the Service, or access it by automated means except through features we provide for that purpose.

If you send us ideas or suggestions, we may use them without restriction or payment to you. Your feedback does not give us any rights in Your Content.

You can stop using the Service at any time, and ask us to delete your account by writing to hello@heyperai.com.

We may suspend or close your account if you seriously or repeatedly break these Terms, if the law requires it, or if your use puts other people or the Service at risk. Where it is reasonable and lawful, we will tell you why and give you a chance to respond first. If we close your account without cause, we will refund any prepaid, unused part of your subscription.

Sections that by their nature should survive — including ownership, disclaimers, limits of liability and governing law — continue after the agreement ends.

AI output is generated by probabilistic models. It can be inaccurate, offensive, unexpected, or similar to existing works, and it is not advice. Review outputs before you rely on them or publish them.

To the fullest extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise the Service will be uninterrupted or error-free.

To the fullest extent the law allows, Heyperai will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Service.

Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose and US$100.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence, or removes rights you have as a consumer under the law of the country where you live.

If you use the Service for business purposes, you agree to defend and compensate Heyperai against third-party claims, and related costs, arising from Your Content or from your breach of these Terms or of the law.

We may update these Terms as the Service and the law change. When a change is material, we will tell you by email or in the app at least 14 days before it takes effect, unless it is required sooner by law or to deal with misuse. If you keep using the Service after a change takes effect, the updated Terms apply; if you don't agree, you can close your account.

These Terms are governed by the laws of India, and the courts of India have jurisdiction over disputes, except where the law of the country you live in gives you the right to bring a claim in your local courts or under your local law.

Before starting a formal dispute, please email hello@heyperai.com and give us 30 days to try to resolve it informally. Most problems are solved this way.

In line with India's Information Technology Act, 2000 and the rules made under it, complaints about content on the Service or about these Terms can be sent to our grievance officer at hello@heyperai.com. We acknowledge complaints within 24 hours and aim to resolve them within 15 days.

These Terms and the policies they refer to are the whole agreement between you and us about the Service. If a part of them is found unenforceable, the rest remains in effect. Not enforcing a right is not a waiver of it. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets, and will tell you if we do.
